Higher-Level Reviews Explained

A Higher-Level Review asks a more experienced VA adjudicator to review the prior decision using the evidence already in the record; new evidence is not allowed.

Quick answer

A Higher-Level Review uses VA Form 20-0996 or the official online process. The reviewer looks for factual or legal error, may change the decision based on a difference of opinion, or may identify a pre-decisional duty-to-assist error that requires corrective development.

When the lane may fitDetails
  • The relevant evidence was already in VA’s possession before the decision.
  • The decision misread a record, overlooked a favorable fact, or applied the wrong standard.
  • The diagnostic code or rating criteria appear to have been applied incorrectly.
  • VA failed in its duty to assist before issuing the decision.
  • No new evidence is needed to explain the alleged error.
What cannot be addedDetails
  • New medical records.
  • A new nexus opinion.
  • A new personal or buddy statement offered as evidence.
  • Testing completed after the prior record closed.
  • An informal conference does not reopen the record; it identifies error based on the existing record.
Prepare an error listDetails
  • Identify the exact issue and decision date.
  • Cite the record that was already present and where it appears.
  • State the factual or legal error briefly.
  • Explain the requested correction without introducing new facts as evidence.
  • Decide whether an optional informal conference would add clarity.
Common questionsDetails
  • Will the reviewer simply approve the claim? — The reviewer may grant, continue, or change the decision, or return it for correction of a duty-to-assist error.
  • Can an HLR order a new exam? — If a pre-decisional duty-to-assist error is found, VA can conduct corrective development outside the HLR decision.
  • Can I request HLR after HLR on the same issue? — VA describes limits on successive HLRs; review the available options after the decision.
  • Does HLR preserve the effective date? — Timely continuous pursuit may preserve the chain, subject to the rules.
Choose another lane if evidence is neededDetails

If the solution requires a new medical opinion, record, or statement, a Supplemental Claim or an evidence-accepting Board docket may be more procedurally appropriate.
