Understanding VA Effective Dates

The effective date is the legally assigned start date for an award or evaluation; it is governed by claim history, entitlement, and specific exceptions—not simply symptom onset.

Quick answer

For many disability awards, the general rule is the later of the date VA received the claim or the date entitlement arose. Important exceptions apply to claims filed soon after separation, increased ratings, presumptive claims, liberalizing laws, continuously pursued review, and other situations. Payment timing is related but not identical to the effective date.

Documents that control the timelineDetails
  • Intent-to-file confirmation.
  • Completed application receipt.
  • Prior decisions and the date notice was issued.
  • Supplemental Claim, Higher-Level Review, or Board Appeal receipts.
  • Medical or other evidence showing when entitlement or worsening became ascertainable.
  • Any withdrawal, abandonment, or final break in continuous pursuit.
Common effective-date settingsDetails
  • Original claim filed more than one year after separation: generally no earlier than the claim date, subject to the date entitlement arose.
  • Claim filed within one year after separation: special rules may allow the day after separation.
  • Increase: the regulation contains a factually-ascertainable one-year lookback rule in qualifying circumstances.
  • Decision review filed within the applicable period: continuous-pursuit rules may preserve the chain.
  • Changed law or added presumption: special effective-date rules may apply.
Build a procedural timelineDetails
  • Use exact received and decision-notice dates.
  • Identify the issue at each stage; a similar name may not be the same continuously pursued issue.
  • Mark which evidence existed and when.
  • Do not assume the diagnosis date automatically controls.
  • Keep official confirmations and envelopes or electronic notices when timing matters.
Common questionsDetails
  • Why not the date I became ill? — The law often uses the later of claim receipt or entitlement, with specific exceptions.
  • Does an intent to file guarantee the date? — Only if followed by the appropriate completed claim within the required period and the ITF applies.
  • Can a new presumption create an earlier date? — Liberalizing-law and special rules are complex and depend on the claim history.
  • Is back pay calculated through the effective date? — VA payment generally begins under separate commencement rules, commonly the first day of the following month.

Earlier-effective-date questions involving old denials, reopened issues, new presumptions, clear and unmistakable error, or continuous pursuit are legal matters suited to a VA-accredited representative.
